Copyright & Confederation

Confederation College has an Interim Tariff agreement with Access Copyright, the Canadian Copyright Licensing Agency, that allows an educational institution and persons acting under its authority to legally photocopy from published works within specific limits.

Confederation College has adopted a Fair Dealing Policy (as recommended by ACCC).  Fair dealing is an exception in the Copyright Act which permits the use of copyright protected material without permission or payment of royalties provided the "dealing" or use is for one of the purposes set out in the Copyright Act - Section 29 - Exceptions - Fair Dealing: research, private study, review, criticism, or news reporting.

Most print copying situations are covered by either the Interim Tariff, or the ACCC Fair Dealing Policy. Digital, audiovisual, or music copying is not covered in the Interim Tariff. 

Some basic principles: 

  • The college abides by the Copyright Act of Canada.  The copyright owner is the author of the work, and only the author can give permission to others to copy his work.
  • Copyright means the right to copy
  • Copyright applies to all original works e.g. dramatic and musical works, sculptures, paintings, photographs, films, computer programs, CDs, records, tapes, etc.
  • Purchasing a book or video does not mean that you own the copyright. No one is allowed to copy without first obtaining permission from the copyright owner

 

Course Packs

If you are copying and binding, packaging or assembling photocopies from more than one publication, that is considered a coursepack, as per the Interim Tariff.

All Confederation College faculty and staff must complete a copyright log and pay royalties when copying materials for coursepacks.  Access the current Copyright Log spreadsheet and e-mail the completed log to the Library Public Service Officer

 

Videos and Copyright

  • Videos and DVDs purchased or rented from a video store are FOR HOME USE ONLY. They do not have public performance rights
  • Public performance rights are required when showing videos or DVDs in classrooms, schools, clubs, etc.
  • The Library provides a collection of videos/DVDs with and without performance rights
